These Terms & Conditions ("Terms") govern your access to and use of the Windows VPS hosting services offered by TradeVPS ("TradeVPS", "we", "us", "our"). By creating an account, purchasing a plan, or otherwise using our services, you agree to these Terms.
TradeVPS provides Windows-based virtual private server (VPS) infrastructure on a subscription basis. Services are provided on an "as-available" basis and are subject to the availability of upstream providers and network conditions.
TradeVPS is not a trading platform, brokerage, exchange, investment adviser, or financial services provider. We do not offer trading signals, advice, strategies, or copy-trading of any kind. Our role is strictly limited to providing VPS infrastructure that customers may use to run software of their choice, within the limits of these Terms and the Acceptable Use Policy.
Use of the service is subject to our Acceptable Use Policy. You must not use TradeVPS infrastructure for illegal activity, spam, malware distribution, denial-of-service attacks, unauthorized access to third-party systems, adult/CSAM content, or any activity that violates applicable law.
Refunds are governed by our Refund Policy. In summary: we consider refund requests on a case-by-case basis for infrastructure failures directly attributable to TradeVPS. Refunds are not provided for issues arising from customer software, misconfiguration, or third-party services.
We may suspend or terminate a VPS immediately if we detect abuse, illegal activity, payment failure beyond the grace period, security incidents caused by customer software, or breach of these Terms. Where practical, we will notify you before suspension for non-abuse reasons.
Lifecycle: ACTIVE → EXPIRING → EXPIRED → GRACE PERIOD → SUSPENDED → TERMINATED. Once terminated, VPS data cannot be recovered.
Abuse reports may be sent to our support channel. Confirmed abuse (spam, phishing, DDoS, malware, IP-based attacks, harassment) will result in immediate suspension without refund.
Customers are solely responsible for backing up their own data. TradeVPS does not guarantee automatic backups unless a specific backup add-on is purchased. We strongly recommend regular off-server backups.
While we target high availability, no VPS provider can guarantee zero downtime. Scheduled maintenance, upstream outages, hardware failures, and network incidents may cause temporary unavailability. TradeVPS does not offer a formal SLA-backed credit unless expressly stated in your plan.
To the maximum extent permitted by law, TradeVPS, its owners, employees, and affiliates shall not be liable for:
Aggregate liability for any claim arising out of the service is capped at the amount paid by you for the affected VPS in the three (3) months preceding the claim.
TradeVPS is not responsible for the availability, security, correctness, or output of any third-party software installed on your VPS. This includes trading platforms, expert advisors, browsers, business apps, and every other tool the customer may install. VPS performance depends materially on the customer's software configuration.
Personal data is handled in accordance with our Privacy Policy.
The TradeVPS brand, logo, website content, and platform code are owned by TradeVPS. You retain all rights to data and software you upload to your VPS.
You may cancel renewals at any time from the dashboard. Cancellation stops future billing; the current billing period will continue to its natural expiry.
Neither party is liable for failures resulting from causes outside its reasonable control including acts of God, natural disasters, war, terrorism, government actions, upstream provider outages, or internet-scale failures.
These Terms are governed by the laws of India. Courts at New Delhi shall have exclusive jurisdiction over any disputes.
We may update these Terms from time to time. Material changes will be notified via email or dashboard notice. Continued use after changes constitutes acceptance.
